At KidzByte Mediatech Private Limited, We care about Your Personal Data, so We have prepared this Privacy Policy to explain how We collect, use and share it.
This Privacy Policy (“Privacy Policy”) details the Personal Data KidzByte Mediatech Private Limited (“KidzByte”, the “Company”, “We”, “Us” or “Our”) receives about You, how We collect, use and process it and Your rights and obligations in relation to Your Personal Data. The Company having its registered office at A-2, DSK Madhuban, Andheri, Mumbai-400072, India, is the data controller for the purposes of the General Data Protection Regulation (“GDPR”) and any relevant local legislation (“Data Protection Laws”).
This Privacy Policy is designed to comply with GDPR and is also designed to comply with the Children's Online Privacy Protection Act, 1998 ("COPPA") and applies to all products and services offered by Kidzbyte. For the purposes of this Privacy Policy, "child" or "children" means a child or children under 13 years old.
This Privacy Policy contains information about the website www.kidzbyte.com (“Website”), web application and corresponding mobile application called KidzByte (“App”) (hereinafter collectively referred to as the “App”). This Privacy Policy applies whether You use KidzByte through Our Website, Our web application or Our App, or any of Our other products or services that link to this Privacy Policy (collectively, the “Service”). By using the Service, You acknowledge that You accept and agree to this Privacy Policy.
Access to the contents available through the App is conditional upon Your approval of this Privacy Policy which should be read together with the terms and conditions of use (“Terms”). You acknowledge that this Privacy Policy, together with our Terms, forms Our agreement with You in relation to Your use of the App (this “Agreement”). The use of Our Apps, or Services, and any dispute over privacy, is subject to the Agreement, including its applicable limitations on damages and the resolution of disputes.
1. Capitalized terms, not defined in the Terms and Conditions located at www.kidzbyte.com or elsewhere in this Agreement shall mean as follows :
(a) “You”, “Your”, “Yourself” and “User” shall mean and refer to natural and legal individuals who use the App.
(b) “Personal Information/ Personal Data” shall mean and refer to any personally identifiable information that We may collect from You. For removal of any doubts, please refer to Clause 3.
(c) “Third Parties” refer to any website, company or individual apart from the User and the creator of this Website.
2. Any reference to singular includes a reference to the plural and vice versa, and any reference to one gender includes a reference to other gender(s), unless explicitly provided for.
3. Headings and captions are used for convenience only and not for interpretation of the Agreement.
4. Any reference to a natural person shall, include his/her heirs, executors and permitted assignees and any reference to a juristic person shall, include its affiliates, successors and permitted assignees, unless repugnant to the context.
1. In order to provide the App, We may require You to provide the following information :
(a) Whether You are an educator/ parent/ learner, (b) Your name, (c) Your phone number, (d) Your e-mail address, (e) Your gender, (f) Your date of birth, (g) Your school name, (h) Your school grade. Since We give Our Users an option to sign in to the App through third party sign-in services, such as their Facebook or Google account, the aforesaid information may be entered by the User from the User’s account with such third party sign-in services.
2. In addition to the information listed above, We automatically collect some information from any use of Our Service as set forth in the "Information collected automatically" section.
3. You will also provide Us with Your payment transaction information if You choose to pay for the services available on Our App. The Company will not use Your financial information for any purpose other than to complete a payment transaction with You. To the extent possible, We provide You the option of not divulging any specific information that You wish for Us not to collect, store or use. You may also choose not to use a particular service or feature on the App, and opt out of any non-essential communications from the App.
4. If You communicate with Us by, for example, e-mail or letter, any information provided in such communication may be collected by KidzByte. When Users use Our Service, We automatically collect and store certain personal information provided by You from time to time in Our server logs. We collect and store Your search details on the App, including Your search history, the usage of the website and the features and time You have used the website for.
5. We are committed to keeping all such sensitive data/information safe at all times and ensure that such data/information is only transacted over secure site of approved payment gateways which are digitally encrypted, and provide the highest possible degree of care available under the technology presently in us. Further, transacting over the internet has inherent risks which can only be avoided by You following security practices Yourself, such as not revealing account/login related information to any other person and informing Our customer care team about any suspicious activity or where Your account has/may have been compromised.
6. At every stage prior to, during or after information collection, You have the right to access all personally identifiable information provided, rectify or alter all personally identifiable information provided, restrict the level of information to be retained as per Your sole discretion and object to the retention, use and potential disclosure of the personally identifiable information.
7. This Privacy Policy also applies to data We collect from users who are not registered as members of this App, including, but not limited to, browsing behaviour, pages viewed etc.
8. Third Party Data
We also collect information about You from third parties. For more information, see Information obtained by Third Parties.
9. Product Research and Development
We may contact You to participate in product research activities. These may include surveys, interviews, and other types of feedback sessions. When You participate in these research activities, the information You provide will be used to test, improve, and develop Our products. We will record the video, audio and text transcriptions of this feedback together with any additional contact information You provide and will retain this data for two years.

KidzByte may send push notification to Users - for example, letting them know when they have received new news updates. If You are a User or a parent of a User who is a child and no longer want these communications to be sent, please either turn off the push notifications on Your device, or contact Us at admin@kidzbyte.com
If You are the parent or legal guardian of a child who has created a KidzByte account and You were not informed that Your child has created the said account, You can email Us at admin@kidzbyte.com to have that child’s account deleted.
Any parent that want copies of their children’s personal information that We may have stored can contact Us by sending an email to admin@kidzbyte.com. At any time, parents can refuse to permit Us to collect further personal information from their children, and can request that We delete the personal information We have collected from their child by contacting Us at admin@kidzbyte.com. Please keep in mind that deleting records may require Us to terminate the account in question. Also remember that before We can share the information with You, or delete it per Your request, We will need to verify Your identity, for example by requiring that You provide acceptable forms of personal identification.
We (or Our service providers) may automatically receive and log information on Our server from Users’ browsers or devices when they use the Service. If Users’ use KidzByte on different devices, We may link the information We collect from those different devices to help Us provide a consistent Service across their different devices. If We do combine any automatically-collected information with Personal Information, We will treat the combined information as Personal Information, and it will be protected as per this Privacy Policy.
The technologies and information We automatically collect include:
1. Kidzbyte does not sell or rent Your Personal Information to any third party for any purpose - including for advertising or marketing purposes. Targeted advertising is not permitted on Kidzbyte. We use the information We collect from Users to provide them with the best KidzByte experience.
2. More specifically, this information is used:
i. To help Us make decisions on what We should work on next. For example (i) Details of how the User has used Our service, such as their activity on the Service, and the frequency and duration of their visits to the App (ii) IP address, (iii) Device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of their request and referral URL;
ii. To enable the provision of Services opted for by You;
iii. To communicate necessary account and service related information from time to time;
iv. To allow You to receive quality customer care services;
v. To comply with applicable laws, rules and regulations;
vi. To tailor the content and information that We may send or display to Users, to offer personalized help and instructions, and to otherwise personalize student experiences while using the Site, App, or Services;
vii. To better understand how Users access and use Our Site, App, and Services, on an aggregated or de-identified basis, in order to improve Our Site, App, and Services and respond to user desires and preferences, and for other research and analytical purposes.
viii. To provide You with advertising that better suits Your interests and profile and is age-/gender-appropriate and targeted to Your general location;
ix. To serve and measure the effectiveness of advertising.
3. We use automatically collected information (described in the "Information collected automatically" section above) to provide and support Our Service, and for the additional uses described in this section of Our Privacy Policy.
4. We may occasionally send You service related and product change announcements through the general operation of the Service. We may also use Your contact information to send You notifications regarding new services, offers and promotions offered by KidzByte if You affirmatively consent to receive such communications.
5. We shall immediately delete all such information upon withdrawal of Your consent for the same through Our ‘unsubscribe’ through an email to be sent to admin@kidzbyte.com
1. As a matter of policy, We do not sell or rent any personally identifiable information about You to any third party. Furthermore, we do not share personal information with any third parties except in the limited circumstances described in this Privacy Policy:
a. Service Providers: Targeted advertising is not permitted on KidzByte. We do work with vendors, service providers, and other partners to help us provide the Service by performing tasks on Our behalf. We may need to share or provide information (including personal information) to them to help them perform these business functions, for example sending emails on our behalf, database management services, database hosting, providing customer support software, and security. Generally, these service providers do not have the right to use students’ personal information we share with them beyond what is necessary to assist Us. Additionally, these service providers must adhere to confidentiality and security obligations in a way that is consistent with this Privacy Policy.
b. External Service Providers: There may be a number of services offered by external service providers that help You use Our Websites. If You choose to use these optional services, and in the course of doing so, disclose information to the external service providers, and/or grant them permission to collect information about You, then their use of Your information is governed by their privacy policy.
2. Law and Order: We cooperate with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights. We can (and You authorize us to) disclose any information about You to law enforcement and other government officials as We, in Our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us or You to legal liability.
3. Analytics: We use analytics services, including mobile analytics software, to help Us understand and improve how the Service is being used. These services may collect, store and use Personal Information in order to help us understand things like how often students use the Service, the events that occur within the application, usage, performance data, and from where the application was downloaded.
4. Public: We may share aggregated, non-personally identifiable information publicly, including with users, partners or the press in order to, for example, demonstrate how KidzByte is used, spot industry trends, or to provide marketing materials for KidzByte. Any aggregated information shared this way will not contain any personal information.
5. Affiliates: Over time, KidzByte. may grow and reorganize. We may share User’s personal information with affiliates such as a parent company, subsidiaries, joint venture partners or other companies that we control or that are under common control with us, in which case we will require those companies to agree to use User’s personal information in a way that is consistent with this Privacy Policy.
6. Reorganisation: In the event that all or a portion of KidzByte or its assets are acquired by or merged with a third party, Personal Information that we have collected from Users would be one of the assets transferred to or acquired by that third party. This Privacy Policy will continue to apply to students’ information, and any acquirer would only be able to handle students’ personal information as per this policy (unless teachers give consent to a new policy). We will provide Users with notice of an acquisition within thirty (30) days following the completion of such a transaction, by posting on our homepage, or by email to teachers’ email addresses that they provided to Us. If you do not consent to the use of User’s personal information by such a successor company, you may request its deletion from the Company.
7. In the unlikely event that KidzByte goes out of business, or files for bankruptcy, we will protect User’s personal information, and will not sell it to any third party
8. Due to the existing regulatory environment, We cannot ensure that all of Your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting and foregoing), We may be forced to disclose information to the government, law enforcement agencies or third parties. Therefore, although We use industry standard practices to protect Your privacy, We do not promise, and You should not expect, that Your personally identifiable information or private communications would always remain private. We do, however assure You that any and all disclosure of Your personally identifiable information shall be personally intimated to You through an email sent to Your provided email address.
You can manage Your account settings on the App to update, amend, and correct Your information.
Unless subject to an exemption, You also have the following rights in relation to the Personal Data We hold about You, unless provided otherwise by local law:
- To request access to, or erasure of, the Personal Data We hold about You.
- To request us to restrict the processing of the Personal Data We hold about You.
- To object to us processing Personal Data relating to You.
- Where You have given us consent to process Your Personal Data, You have the right to withdraw that consent at any time.
- To export the Personal Data You have provided to KidzByte in a format that can be transferred electronically to a third party.
- To delete Your account with KidzByte by following the instructions available through the Service.
- To request a copy of Your Personal Data which We hold about You;
- To request for any correction to any Personal Data if it is found to be inaccurate or out of date;
- To lodge a complaint with a supervisory authority
- To obtain information as to whether Personal Data are transferred to a third country or to an international organization.
Please note that some of these rights are not absolute. In some cases, We may refuse a request to exercise particular rights if complying with it meant that We are no longer able to meet Our contractual obligation to provide You with particular services. We will keep You informed as to the actions that We can take when You make Your request.
You may also have the right to make a GDPR complaint to the relevant Supervisory Authority. If You need further assistance regarding Your rights, please contact Us using the contact information provided below and We will consider Your request in accordance with applicable law. In some cases Our ability to uphold these rights for You may depend upon Our obligations to process personal information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services You have requested. Where this is the case, We will inform You of specific details in response to Your request.
Please note that You may have cookies placed on Your computer by third party websites that refer You to Our Service. Although We do not share Your Personal Data with these third party websites unless it is reasonably necessary to offer the Service, they may be able to link certain non-personally identifiable information We transfer to them with Personal Data they previously collected from You. Please review the privacy policies of each website You visit to better understand their privacy practices. In addition, KidzByte would like to inform You that anytime You click on links (including advertising banners), which take You to third party websites, You will be subject to the third parties’ privacy policies.
Our Services contain links to other sites operated by third parties. The App may include advertisements, hyperlinks to other websites, applications, content or resources. KidzByte does not control such other sites and is not responsible for their content, their privacy policies, or their use of Personal Data, including any personal or financial information collected by Our third party payment processor to process payments for in-app purchases. KidzByte’s inclusion of such links does not imply any endorsement of the content on such sites or of their owners or operators except as disclosed on the Services. Any information submitted by You directly to these third parties is subject to that third party’s privacy policy.
Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information We collect from You. To the extent that You disclose Your information to other parties, whether they are on Our Websites or on other sites throughout the Internet, different rules may apply to their use or disclosure of the information You disclose to them. To the extent that We use third party advertisers, they adhere to their own privacy policies. Since We do not control the privacy policies of the third parties, You are subject to ask questions before You disclose Your personal information to others.
KidzByte provides some features and services intended for use by children. KidzByte uses age-gating to restrict what services are available to children depending on the age of the User and the applicable laws of their country. For example, a 15 year old child in Germany will require parental consent to use the Service, whereas a 12 year old child in the United States of America would receive a restricted service but not require parental consent.
1. Advertisements
KidzByte complies with applicable legal obligations relating to advertising to children. Advertisements displayed to children do not involve interest-based advertising or remarketing. Advertisements displayed to child audiences present content that is appropriate for children. Advertisements displayed to children follow the Designed for Families ad format requirements and are not deceptive or disruptive in any manner.
As mentioned above, however, to the extent that We use third party advertisers, they adhere to their own privacy policies.
(i) Children within the European Union
Each European Union (EU) member state is permitted to legally define its own digital age of consent between 13 and 16. KidzByte checks the age and country of the user to determine if the user is able to consent to the Service. If consent of a parent/guardian is required, the user will input the e-mail address of an adult who will receive a request to approve the child’s account registration. In the absence of a country specific Act of Law, the age of consent will be set at 16.
These EU child users will receive the following service restrictions: they will not be able to use the service until their parent/educator has provided consent for the child to do so. After the parent/educator has given consent, their child will be allowed to access the full KidzByte service.
With respect to such a User, We will prevent the collection and use of his/her precise geolocation data and display to him/her contextual advertising only (excluding any behavioral advertising).
Where KidzByte does make features and services available to children, We recognize that collecting Personal Data from children requires further privacy protections. Accordingly, KidzByte will: (1) if requested by parents or guardians, notify parents or educators about KidzByte’s privacy and information practices regarding children, including what Personal Data We collect and how We use, share, and protect that Personal Data; (2) limit Our collection of Personal Data to ensure that We collect no more than is necessary to provide KidzByte’s services; and (3) allow parents to request that KidzByte change or delete Personal Data about their children.
(ii) Children outside of the European Union
If a child of under 13 years from outside the EU registers for the KidzByte service, upon registration the child will provide an adult’s e-mail address, to whom KidzByte sends a notification.
With respect to such a User, We will prevent the collection and use of his/her precise geolocation data and display to him/her contextual advertising only (excluding any behavioral advertising).
- Instead of any Personally Identifiable Information about the child, We will only store the e-mail address of their parent/guardian.
- Only family friendly advertisements are shown and these ads do not do behavioral tracking.
These child Users will receive the following service restrictions:
- Mature words such as "beer" and "wine" are disabled.
- Social features are disabled, e.g. profiles, forums, clubs, etc.
- They cannot enter profile information such as a profile picture or a bio.
At the point when the user is known to have reached the age of 13, the account will automatically be transitioned to be a normal non-restricted account.
At all times KidzByte does not knowingly collect personal information from children in connection with the Service. If We discover that We have unknowingly collected personal information from these children, We will delete it. If You believe We have collected personal information from a child, please contact Us at admin@kidzbyte.com
2. INFORMATION SECURITY
We treat data as an asset that must be protected against loss and unauthorized access. The security of Users’ personal information is important to Us.
User’s accounts are protected by a password. Users can help Us protect against unauthorized access to their account by keeping their password secret at all times. We employ many different security techniques to protect such data from unauthorized access by members inside and outside the Company. We follow generally accepted industry standards to protect the Personal Information submitted to Us and information that We have accessed.
In particular:
- Our engineering team is dedicated to keeping Users’ Personal Information secure
- We continually develop and implement features to keep Users’ Personal Information safe - for example, when Users enter any information anywhere on the Service, We encrypt the transmission of that information using secure socket layer technology (SSL/TLS) by default.
- We ensure passwords are stored and transferred securely using encryption and salted hashing.
KidzByte has implemented administrative and technical safeguards it believes are appropriate to protect the confidentiality, integrity and availability of Your Personal Data, Testing ID, User Photo and access credentials. No practices however are 100% immune, and We can’t guarantee the security of information. Given sufficient resources, a determined attacker could defeat the aforesaid safeguards and may, as a result, gain access to the data We seek to protect. Outages, attacks, human error, system failure, unauthorized use or other factors may also compromise the security of User information at any time. If We learn of a security breach, We will attempt to notify Users electronically (subject to any applicable laws) so that they can take appropriate protective steps; for example, We may post a notice on Our homepage (www.kidzbyte.com) or elsewhere on the Service, and may send emails to the Users at the email address they have provided to Us.
Following registration, You can review and change the information You submitted at the stage of registration, except Email ID. An option for facilitating such change shall be present on the Website and such change shall be facilitated by the User. If You change any information, We may or may not keep track of Your old information. We will not retain in Our files information You have requested to remove for certain circumstances, such as to resolve disputes, troubleshoot problems and enforce Our terms and conditions. Such prior information shall be completely removed from Our databases, including stored ‘back up’ systems. If You believe that any information We are holding on You is incorrect or incomplete, or to remove Your profile so that others cannot view it, the User needs to remediate, and promptly correct any such incorrect information.
How can I delete my child’s account?
If You ever want to delete Your child’s account, You can do that at any time by contacting Us at admin@kidzbyte.com When You delete Your child’s account, We delete their profile information, feedback, and information collected through the mobile permissions they’ve granted. Information that they have shared with others, others have shared about them, or content other Users may have copied and stored, is not part of a Users account and may not be deleted when We delete a Users’ account.
How long does KidzByte keep information about students?
We shall collect and store all such information in Our internal Company servers for a finite period time, as long as You are a User of the App, and shall immediately delete all such information upon expiry of Your Usership. We shall also delete all aforementioned communication upon withdrawal of Usership of any single Party to the communication. We also reserve the right to terminate User accounts that have not been accessed for a period of more than one year, unless We are required by law to retain it, need it to ensure the security of Our community or Our Service, or to enforce Our Terms.
Each paragraph of this Privacy Policy shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise expressly indicated or indicated by the context of the agreement. The decision or declaration that one or more of the paragraphs are null and void shall have no effect on the remaining paragraphs of this Privacy Policy.
Our Privacy Policy may change from time to time. The most current version of the policy will govern Our use of Your information and will always be at the App.
As a responsible company, We do not use automatic decision-making or profiling.
The Service is not designed to respond to “do not track” signals sent by some browsers.

To withdraw Your consent, or to request the download or delete Your data with Us, please email to admin@kidzbyte.com from Your registered email address. The Company shall take thirty (30) calendar days from the date of receiving the request to comply with the same.
We may occasionally update this Privacy Policy - You can see when the last update was by looking at the “Last Updated” date at the bottom of this page. If We make any significant changes, We’ll provide a notice of those changes so Users can review and make sure You know about them. We may post a notice on the KidzByte Website, notify Users by email (using the email address they provided), and/or alert them upon logging into the App.
In addition, if We ever make significant changes to the types of Personal Information We collect from children, or how We use it, We will notify parents in order to obtain parental consent or notice for those new practices.
We encourage You to review this Privacy Policy from time to time, to stay informed about Our collection, use, and disclosure of personal information through the Service. If You don’t agree with any changes to the Privacy Policy, You may ask Us to terminate Your child’s account. By continuing to use the Service after the revised Privacy Policy has become effective, Users and/or parents acknowledge that they accept and agree to the current version of the Privacy Policy.

These terms and conditions of use (“Terms”) along with privacy policy (“Privacy Policy”) forms a legally binding agreement (“Agreement”) between You and Us (“KidzByte Mediatech Private Limited”, “KidzByte”, “Our”, “We”).
Hence, We insist that You spend time reading these Terms and Privacy Policy and let Us know at admin@kidzbyte.com if You have any questions regarding the same. We will try our best to answer Your queries.
Since You downloaded Our App from Google Play, You will also be subject to Google Play Terms of Service. If there is any conflict between Google Play Terms of Service and this Agreement with respect to Your use of the App, then, this Agreement shall prevail.

(a) “App” means the android mobile platform downloadable from Google Play and owned by KidzByte, including any updates thereof.
(b) “Google Play” means the service provided by Google Ireland Limited, a third party, located at Gordon House, Barrow Street, Dublin 4, Ireland and/or its affiliates, which You may use in order to download the App.
(c) “Google Play Terms of Service” means terms of service that apply to the use of Google Play and available at https://play.google.com/about/play-terms.html.
(d) “User” or “You” or “Your” refers to a natural person who has accepted this Agreement in order to download and use the App.

1. You approve of and accept this Agreement by:
(a) downloading and/or installing the App on Your device; or
(b) accessing or using the App or any of the content available within the App from any device.
2. You can accept this Agreement only if:
(a) You are of the legal age, eligibility and mental capacity to form a binding contract with KidzByte pursuant to Your use of the App;
(b) You are not legally barred from using the App;
(c) Minors, un-discharged insolvents etc. are not eligible to use our products or services. As a minor if you wish to use our products or services, such use shall be made available to you by your legal guardian or parents. KidzByte will not be responsible for any consequence that arises as a result of misuse of any kind of our products or services that may occur by virtue of any person including a minor using the services provided. By using the products or services you warrant that all the data provided by you is accurate and complete and that you have obtained the consent of parent/legal guardian(in case of minors). KidzByte reserves the right to refuse to provide you with access to the products or services if it is discovered that you are under the age of 18 years and the consent to use the products or services is not made by your parent/legal guardian or any information provided by you is inaccurate.
3. You understand that We want You to not use the App if You do not understand, approve of or accept all the terms specified in this Agreement. Hence, You are requested to read these Terms carefully and understand the Agreement before You accept it and agree to be bound by it.
1. The App is designed to provide You an in-app browsing experience through an embedded browser. The App does not per se provide any news or content or information; but provides a brief summary of the content available in public domain by aggregating such content within one platform for easy access by You and for assisting You to find corresponding content of Your interest. When You read a summary, You may be linked to one of the online sources of such duly aggregated summary, upon tapping “News Source” and “Image Source” tab on Your screen. You agree and acknowledge that the App does not report and/or broadcast any content (including news) on its own accord and KidzByte is not responsible or liable for the content or accuracy of the summary of content that may be accessed by You through the App.
2. The App may include links to other mobile applications and/or websites (some of which may be automated search results) which may contain materials that are objectionable, unlawful, or inaccurate. We do not endorse or support these links or the products and services they provide; these links are provided for Your convenience only. We are not responsible or liable for the content or accuracy of such links.
3. In order to provide the App to You, We may request You to register and/or provide information about yourself. We trust that any information provided by You will always be true, accurate, complete and updated.
4. The content displayed on the App is for Your non-commercial and personal use. You are not allowed to copy, reproduce, alter, modify, create derivative works of, or publicly display any content displayed on the App.
5. We may stop provision of the App (or any part of the App), permanently or temporarily, to You or to Users generally or may modify or change the nature of the App and/or these Terms at Our sole discretion, without any prior notice to You. Your use of the App following any such modification constitutes Your deemed acceptance to be bound by the Agreement (or as it may be modified).
1. A violation of this Agreement may result in a legal liability upon You and that nothing in this Agreement should be construed to confer any rights to any third party. You are responsible for Your conduct and activities while using the App, and for any consequences thereof.
2. If any provision of the Agreement is found to be unenforceable under the applicable law, it will not affect the enforceability of the other provisions of this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remaining provisions shall be enforced.
3. We may choose to not act with respect to a breach of this Agreement by You or others but this does not mean that We cannot act with respect to subsequent or similar breaches. Our intended or intended failure to exercise or enforce any provision of this Agreement shall not constitute a waiver of such right or provision.
1. You will download and install the App from Google Play for using it. You will also download and update the relevant latest versions of the App and any relevant updates provided by Us to avail continued access to the App.
2. While the App is available to You free of cost, We may amend these Terms and impose a cost on the App in future. We don’t promise to but will try our best to give You a prior notice in this regard.
3. You will use the App only for such purposes as is permitted by (a) this Agreement; and (b) any law, regulation or generally accepted practices or guidelines applicable in the country of which You are a citizen, in which You are a resident or from where You use the App.
4. For Your use of the App, KidzByte grants You a limited, non-exclusive, non-transferable right to install and use the App on Your android device. However, You shall not copy the App or any of its components, except for the purpose of making a single archival back up copy.
5. KidzByte also grants You a non-exclusive, non-transferable license to access such content on the App which is owned by KidzByte. For using any content owned by a third party, You still require a license from such third party, We don’t license such content to You and Your use of content owned by a third party is governed by applicable terms and conditions prescribed by such third party.
1. You will not use the App or any content provided thereof for any purpose that is illegal, unlawful or prohibited by this Agreement.
2. You will not access (or attempt to access) the content provided through the App by any means other than through the App, unless You have been specifically allowed to do so in a separate written agreement with KidzByte.
3. You will not redistribute, sublicense, rent, publish, sell, assign, lease, market, transfer, or otherwise make the App or any component or content thereof, available to third parties.
4. You will not circumvent or disable any digital rights management, usage rules, or other security features of App; remove, alter, or obscure any proprietary notices (including copyright notices) on any portion of the App; and not use the App in a manner that threatens the integrity, performance, or availability of the App.
5. You will not attempt to or engage in any activity that may:
(a) reverse engineer, decompile or otherwise extract the source code related to the App or any part thereof, unless it is expressly permitted by KidzByte to You in writing or is required by the applicable law;
(b) use any robot, spider, retrieval application, or other device to retrieve or index any portion of the App or content thereof;
(c) collect information about users of the App for any illegal or unlawful purpose;
(d) create any user accounts by automated means or under false or fraudulent pretences for using the App;
(e) transmit any viruses, worms, defects, trojan horses, or any items of a destructive nature through the App;
(f) use the App in any manner that could damage, disable, overburden, or impair, or undertake any action which is harmful or potentially harmful to, any of the servers, networks, computer systems or resources connected to any of the servers connected, directly or indirectly to the App, or interfere with any other third party's use and enjoyment of the App;
(g) carry out any denial of service (DoS, DDoS) or any other harmful attacks on the App or; disrupt or place unreasonable burdens or excessive loads on, or interfere with or attempt to make, or attempt any unauthorized access to the App or any part of the App or any user of the App;
(h) forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the App; or
(i) obtain any materials or information through any means not intentionally made available, in the opinion of KidzByte, through the App.
You will not impersonate another person or impersonate, guide or host on behalf of, or falsely state or otherwise misrepresent Your affiliation with any person or entity, including, but not limited to Our officials, employees, agents, partners, affiliates, dealers and franchisees.
1. Your access to the App may be terminated if:
(a) You voluntarily uninstall the App from Your
(b) You knowingly or unknowingly cause direct or indirect breach, as ascertained by KidzByte, of these Terms or Privacy Policy as a whole or in part; or
(c) You do not pay the requisite fee, if any, should KidzByte charge for use of the App.
2. We may have to terminate Your access to the App if:
(a) We are required to do so by law (for example, where the access to and/or provision of the App to You becomes, unlawful);
(b) The third party, if any, with whom We offered the App to You has terminated its relationship with Us or ceased to offer the related services to Us or to You;
(c) The provision of App to You, is no longer commercially viable or feasible for Us; or
(d) You are a repeat infringer of this Agreement.
3. We may terminate this Agreement at any time, with or without notice and may procure disabling Your access to the App and/or barring You from any future use of the App.
4. You may terminate this Agreement at any time by terminating Your access to the App. However, Your certain obligations under this Agreement shall continue to prevail even on such termination.
5. When this Agreement comes to an end, all of the legal rights, obligations and liabilities that You and KidzByte have benefited from, been subject to (or which have accrued over time whilst the Agreement has been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and shall continue to apply to such rights, obligations and liabilities indefinitely.
1. Your use of the App is, and at all times shall be, governed by and subject to the laws regarding copyright, trademark, patent, and trade secret ownership and use of intellectual property. You agree to abide by laws regarding copyright, trademark, patent, and trade secret ownership and use of intellectual property, and You shall be solely responsible for any violations of any laws and for any infringements of any intellectual property rights caused by Your use of the App through Your device.
2. KidzByte owns and retains all the intellectual property rights to the summarized content made available to You through the App by KidzByte but does not claim ownership rights to the original sources of information, which are instead held by the sites to which the App may link You.
3. All trademarks, brands and service marks of the App are the property of KidzByte only. KidzByte owns all of the copyrights and database in relation to the App.
4. The App and any underlying technology or software used in connection with the App may contain rights of KidzByte or its affiliates or any third party. For use of any third party’s intellectual property, You may need to get permission directly from the owner of the intellectual property.
5. Any intellectual property which is not specifically mentioned to be owned by KidzByte is owned by their respective owners and the owners have a right to take appropriate actions against You for any violation, infringement or passing off.
6. KidzByte respects the intellectual property rights of others and does not hold any responsibility for any violations of any intellectual property rights by You.
1. Our Privacy Policy explains how We treat Your personal data and protect Your privacy when You use the App. By using the App, You agree that We can use such data according to Privacy Policy.
2. You are responsible for maintaining the confidentiality of passwords associated with any device You use to access the App. Accordingly, You are solely responsible for all activities that occur with Your device. If You become aware of any unauthorized use of Your device, You will notify the relevant authorities as soon as possible.
1. Your use of the App or any content available thereof is entirely at Your own risk and We shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, monetary or any other damages, fees, fines, penalties or liabilities whatsoever arising out of or relating to Your use of the App.
2. You may terminate Your access to the App if You are not satisfied with the App.
3. You shall defend, indemnify and hold KidzByte, and its officers, directors, employees, representatives and agents harmless from and against any claims, actions, demands, liabilities, judgments, and settlements, including without limitation, reasonable legal fee that may result from or alleged to result from (a) Your use of the App; or (b) Your breach of any rules, regulations and/or orders under any applicable law.
4. You are also responsible for any breach of Your obligations under the Agreement and/or for the consequences of any such breach.
1. We shall make our best efforts to make the App available to You in the best possible manner. However, We disclaim all warranties in relation to the App, whether express or implied, including but not limited to:
(a) the App being constantly available or available at all;
(b) installation or un-installation choices in relation to the App being successfully executed in all cases;
(c) that App will always function without disruptions, delay or errors;
(d) Your personal ability to use the App;
(e) Your satisfaction with the use of the App;
(f) the accuracy of the data provided by the App;
(g) the security and privacy of Your data;
(h) that all bugs or errors in relation to the App will be corrected;
(i) that the App will be compatible with all devices and all networks;
(j) that the App is fit for a particular purpose or use; or
(k) that the App and the contents thereof are accessible in every location.
2. KidzByte, its officers, directors, employees, affiliates and agents and any other service provider responsible for providing access to the App in connection with this Agreement will not be liable for any acts or omissions, including of a third party, and including those vendors participating in KidzByte’ offerings made to You, or for any unauthorized interception of data or breaches of this Agreement attributable in part to the acts or omissions of third parties, or for damages associated with KidzByte, or equipment that it does not furnish, or for damages that result from the operation systems, equipment, facilities or services provided by third parties that are interconnected with KidzByte.
1. The App may be controlled and operated through any country and may be subject to the laws of that country in which they are controlled and operated. If You use the App from any location, then, You are responsible for compliance with the local laws applicable to You.
2. This Agreement shall be governed by and shall be construed in accordance with the laws of India.
3. You and KidzByte agree that any cause of action arising out of Your use of the App must be commenced within 3 (three) months after the cause of action accrues or You become aware of the facts giving rise to the cause of action, whichever is later. Otherwise, such cause of action shall be permanently barred.
1. KidzByte may post notices within the App or send you notices on the e-mail address or the telephone number that You may have shared with Us. You will have received such notices within 3 (three) days of Us sending the notice. Your continued use of the App on expiry of such 3 (three) days shall constitute Your receipt and acceptance of the notices sent to You.
1. In the event, You desire to become a premium member with Us and want to avail of additional benefits provided by Us, You will be required to make certain payments (as notified by Us) on the App. Additionally, as mentioned above, You will also be required to make certain payments in the event We impose a cost for using the App in the future.
2. You may, therefore from time to time be required to make payments to Us or other third parties in relation to the KidzByte Features. You agree that all such payments from You are subject to, and You will comply with, all terms and conditions of the payment service (whether that payment service provider is us or a third party), in addition to any other relevant terms of this Agreement. We bear no responsibility for any transactions processed by, or any payments made to, a third party, whether or not in connection with the relevant KidzByte Features. You agree that You are solely responsible for all fees and taxes associated with any KidzByte Features, and that pricing and availability of all KidzByte Features are subject to change at any time.
3. You agree that any payments You make to Us in exchange for Your use of any KidzByte Features (for example, KidzByte Features like Power-Up, Double-Up, KidzByte Education etc.) is final and non-refundable, except where otherwise specified by Us for a particular KidzByte Feature. SUBJECT TO MANDATORY APPLICABLE LAWS AND REGULATIONS OR AS OTHERWISE SPECIFIED BY US FOR A PARTICULAR KIDZBYTE FEATURE, IN NO CIRCUMSTANCES WILL WE BE REQUIRED TO PROVIDE A REFUND FOR ANY PAYMENTS MADE BY YOU TO US IN RELATION TO ANY KIDZBYTE FEATURE (WHETHER USED OR UNUSED).
4. Please be aware that You may incur telecommunications charges and other fees and expenses in Your use of the KidzByte Features. You are responsible for paying all such charges, fees and expenses.
1. In the event, You desire to be a premium member with Us, You will need to subscribe to Our one-time or auto-renewing periodic subscription. If You purchase an auto-renewing periodic subscription through the Service, Your KidzByte account will be billed continuously for the subscription until You terminate it as set forth below. After Your initial subscription period, and again after any subsequent subscription period, Your subscription will automatically renew for an additional equivalent period. If You do not wish your subscription to renew automatically, or if You want to change or terminate Your subscription, You will need to log in to Google Play on your computer or Android device and change the settings, even if You have deleted Your account.
2. You agree to pay all fees and applicable taxes incurred by You or anyone using a KidzByte account registered to You. KidzByte may revise the pricing for services offered through the Service at any time. All information that You provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by Users of Your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.
1. The Users acknowledge that one or more of the following modes of payment shall be accepted on the App:
(a) Through credit/debit cards
(b) Through internet banking
(c) Other payment modes
2. The User(s) acknowledge that a minimum of one of the above payment methods shall be offered on the App. The Users are solely responsible for the genuineness of credentials and payment information provided on the App and the App shall not be liable for any consequences, direct or indirect, resulting from the provision of incorrect or untrue credentials or payment information by any Users.
3. Further, the App does not bear any liability for any activities, breaches, discrepancies or technical problems experienced by the Users whilst using any third-party payment gateway to make payments. The relationship between the Users and third-party payment gateway shall be governed by the Terms of Use and Privacy Policy of the said payment gateway, and the App shall not be associated with any dispute arising therefrom.
4. We encourage you to learn about the practices of such third party. In no event will KidzByte be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system downtime or payment service outages.
1.The Company runs contests on the App. Decisions of the management of the Company in relation to such contests shall be final and no disputes shall be entertained by the Company in relation to the same.
2.The Company may request the Users who have won such contests for identity proof to prove that the information provided by the User in relation to the contest is authentic.
1. The contents provided through the App may include technical inaccuracies or typographical errors. KidzByte may make changes or improvements to the App at any time. The contents or any information available on the App is provided "as is" and “as available” and without warranties of any kind either expressed or implied, to the fullest extent permissible pursuant to applicable law. KidzByte does not warrant that the functions contained in the contents will be uninterrupted or error-free, that defects will be corrected, or the servers that make them available, are free of viruses or other harmful components. KidzByte makes no commitment to update the materials on the interface. The above exclusion may not apply to You, to the extent that applicable law may not allow the exclusion of implied warranties. KidzByte shall not be liable for any misuse or data theft as a consequence of Your use of the App.
2. YOU EXPRESSLY REPRESENT AND WARRANT THAT YOU WILL NOT USE THE APP IF YOU DO NOT UNDERSTAND, AGREE TO BECOME A PARTY TO, AND ABIDE BY ALL THE TERMS SPECIFIED IN THIS AGREEMENT. ANY VIOLATION OF THIS AGREEMENT MAY RESULT IN LEGAL LIABILITY UPON YOU. NOTHING IN THE AGREEMENT SHOULD BE CONSTRUED TO CONFER ANY RIGHTS TO ANY THIRD PARTY OR ANY OTHER PERSON.
